Terms of service

The terms that apply when you use kord.nz and buy from us. Please read them; they set out how we work together.

About these terms

These terms apply to your use of the KORD website (kord.nz) and to any order you place with us. By using the site or placing an order, you agree to them. They're written to be clear rather than clever, and they sit alongside your rights under New Zealand law, which they don't limit. KORD is operated by KORD Ltd, New Zealand.

These terms are a plain-language starting point and should be reviewed by a legal professional before you rely on them as your final published terms.

Ordering

You can place an order as a guest; a customer code is optional. When you place an order, you're making an offer to buy the products in your cart at the prices shown. We accept your order when we confirm it and process payment; at that point a contract is formed between you and us. We may decline or cancel an order — for example, if a product is unavailable, a price is clearly wrong, or we can't verify the order — and if we've taken payment for an order we cancel, we'll refund it in full.

Prices and payment

All prices are in New Zealand dollars and include GST. Delivery is charged at a flat $15 per order. Prices may change over time, but the price that applies to your order is the one shown at checkout when you place it. Payment is by card and is processed securely by our payment provider; we don't store your card details.

Delivery

We deliver within New Zealand by tracked courier. Delivery timeframes given on the site are estimates, not guarantees, and depend on the courier network. Risk in the products passes to you on delivery. Please provide an accurate delivery address; we're not responsible for delays or failed delivery caused by an incorrect or incomplete address.

Returns, faults and warranty

Our returns policy and 5-year replacement warranty are set out on their own pages and form part of these terms. Nothing in these terms limits your rights under the Consumer Guarantees Act or Fair Trading Act, which apply where relevant.

Acceptable use

Please use the site lawfully and don't attempt to interfere with it, misuse the ordering or code system, or access parts of it you're not authorised to. We may suspend access where a code is misused or the site is used improperly.

Our liability

We take care to describe products accurately and to supply them as described. To the extent the law allows, we're not liable for indirect or consequential loss arising from your use of the site or products. Nothing here excludes liability that can't lawfully be excluded, including under New Zealand consumer law.

Events outside our control

Occasionally things happen that neither of us can control — courier disruptions, severe weather, supply interruptions, or other events beyond our reasonable control — and where such an event affects delivery or availability, we won't be liable for the resulting delay, but we will do what we reasonably can to keep you informed and to put things right. This doesn't affect your rights under New Zealand consumer law, and it doesn't excuse us from obligations that can't lawfully be excluded. If your order is affected by something like this, get in touch and we'll work through the options with you, whether that's waiting out the disruption, amending the order, or arranging a refund where appropriate. As with the rest of these terms, the intent is to be fair and clear rather than to shift every risk onto you — but it's only sensible to note that some disruptions are genuinely outside anyone's hands.
